Terms & Conditions

BIDDING ON ITEMS 

You must be a registered user to bid on items at Canada Book Auctions (hereon CBA). Your account must be registered with and approved by us, at our sole discretion, before you can use our Services as a Bidder. By bidding, you are entering into a contract to buy the item, and to deliver payment within the time period specified (48 hours after auction close). Bids are final and non-retractable. We accept e-mail bids received up to 2 hours before sale time. 


BIDDER REGISTRATION 

All bidders shall register through their LiveAuctioneers account. 


RESERVE BIDDING 

All Lots may be sold with a reserve amount, below which the lots will not be sold. 


WARRANTY 

All items are guaranteed as described. We strive to offer excellent Customer Service to our clients. Detailed condition reports are available upon request before the auction. If an item is incorrectly described online, CBA reserves the right to rectify such error.

 

PAYMENT 

Full payment must be paid by the Buyer in accordance with the conditions of sale. If you choose to pay by credit card, please note that we pass on a surcharge of 3.75% on the transaction amount for all credit card transactions, which is not greater than our cost of acceptance through the service mandated by LiveAuctioneers. PayPal payments accepted. The Auctioneer also accepts Wise and select CRYPTO currency payments by Bitcoin (BTC) or Ethereum (ETH).


ACCEPTANCE OF TERMS 

A bid placed by any person or agent shall be conclusive proof that he or she acquainted himself or herself with the terms and conditions of sale and agreed to be bound by such terms and conditions prior to placing any bid. 


SHIPPING 

Purchased Lots will be shipped only after payment for Purchased Lots has been paid. Shipping quotes will be sent after the auction invoice has been cleared. CBA charges a Packing & Handling fee of $19.99 per lot, with the exception of lots identified as Overweight/Oversized, for which CBA will charge a Packing & Handling fee of minimum $39.99 per Overweight/Oversized lot. Buyer pays Shipping Cost. CBA will arrange shipping via USPS (American/international buyers) or Canada Post (Canadian buyers) by default unless otherwise requested by the Buyer. We do not ship via DHL. Please note Packing & Handling fees are non-refundable. Please contact CBA before bidding if you have any questions regarding shipping charges. Alternative shipping option: please contact Eddy Chan at PakShip at eddy@pakship.ca. CBA assumes no liability for any damages incurred during shipping and will not be responsible for any loss or damage resulting from the shipping. CBA does not hold any responsibility for shipments made by a third party. Any tariffs will be paid by the importer. Ask us about declaration options. Items not picked up or shipped within 30 days will be considered abandoned. 


SHIPPING INSURANCE 

CBA will not purchase Shipping Insurance unless requested by the Buyer. Shipping Insurance will be paid for by the Buyer. If purchased, Shipping Insurance will cover the cost of the lot(s) purchased, excluding the Premium paid. If loss or damage occurs to a shipment in which the Buyer has purchased Insurance, CBA will not reimburse Premium(s) paid. In case of loss or damage resulting from a shipment in which the Buyer has purchased Insurance, if applicable, CBA will facilitate reimbursement via the selected Shipping Service for the exact amount insured; CBA will not be responsible to provide reimbursement in excess of the exact amount insured. High value invoice purchasers are strongly encouraged to have 3rd party insurance coverage.


RETURN POLICY 

All online items are sold in “as is” condition. All sales are final unless an error of description has been made. Any disputes must be made within ten (10) days of receiving the item. No returns will be accepted without a valid return authorization from CBA. CBA will not refund above and beyond the original costs. We will issue refunds on Online Auction Items, under certain conditions that have been legally (established by or recognized by a court of law) found to be fraudulent, or unauthentic, or stolen. Items are sold as described and as pictured and items will not be refunded due to differing opinions of other companies, people, Authenticators and/or Authentication opinions. consignor terms and conditions

1. The consignor warrants they are the legal owner of the said property; or are agents authorized to act for the current owner and agree to allow the consignee, Canada Book Auctions to sell the property subject to this agreement. The pre-sale estimates are provided as a guide to bidding and are only considered an educated guess based on previous sales data. 


2. The consignor agrees to pay Canada Book Auctions, the consignee, [ hereafter ‘CBA’] a commission from the proceeds of sale. The commission will be based on the hammer price, if sold, per lot, as described in the schedule below, otherwise the minimum charge ($25), and expenses would apply. Other fees could include Pick Up costs and packaging materials, photography ($20 per lot), LiveAuctioneers listing fees ($8 per lot),  and advertising, insurance, conservation or matting as a special requirement or agreement:


Under $1000            25%

$1000.01-$5,000    20%

$5,000.01-$7,500   15%

over $7,500              10%


3. The consignor may set an unpublished and confidential reserve subject to being mutually agreed upon by the consignor and CBA. A buy in fee of 3% will be charged in addition to other incurred fees if the item fails to meet the reserve price during bidding. The consigned items may not be withdrawn from sale after consignment without a 30% fee of the high estimate. We do not accept reserves under $1000.


4. The consignor may not bid, or instruct an agent, to bid on material they have consigned.


5. The consignor may not consign any material known to be a forgery, incomplete, or damaged, and shall provide CBA any information in regard to provenance, conservation, appraisals or related information for the cataloguing process. The consignor agrees and acknowledges that any unsaleable material can be donated and disposed of, and not stored at Canada Book Auctions expense. The consignor agrees to hold CBA harmless for any loss, damage, or legal fees arising from the consignor’s failure to comply with this provision.


6. CBA will pay the net proceeds of the sale 45 business days after the date of the auction, provided we have received full payment from the buyer. CBA will not be liable for any damages resulting from the buyer’s failure to pay or cancelling of a sale.


7. CBA reserves sole discretion as to withdraw a lot from auction and determine the most appropriate auction and date for the sale of all consignments. CBA is not responsible for any property damage caused in the natural process of cataloguing or pre-existing wear or damage. 


8. The consignor warrants in perpetuity CBA the right to reproduce, use, publish, or electronically reproduce any material for the use of promotion, advertising, research, for other publications or media. 


9. The laws of the Province of Ontario shall apply to this agreement. In the event of any dispute, such dispute shall be settled by way of mediation by a mediator chosen CBA and the consignor. Otherwise arbitration pursuant to the arbitration Act of Ontario shall be used to settle the dispute. The consignor acknowledges that they shall be liable to CBA for any and all expenses, losses, damages including legal fees incurred as a result of any breach to this agreement.
